Please read these EurMiles Reward Program Terms & Conditions, since Program enrollment constitutes acceptance of and agreement to them: 1) Eligibility: You must be 16 years of age or older, a resident of the United Kingdom and have a valid e-mail address and internet access to participate in the EurMiles Rewards program. 2) Account Limitation: Only one account may be used by each registered Member; miles in one account cannot be combined with those in any other accounts to earn a Reward. 3) Mileage Expiry: All miles earned during any calendar year (except for enrollment bonus mileage) expire at midnight on December 31, three years after the year when it was earned, unless redeemed for a travel award before that date. For example, miles earned any time in the year 2000 expire on 31/12/2003. EurMiles reserves the right to cancel any account that has no shopping activity within 6 months of the date on which it was opened. 4) Mileage Value: Miles have no cash value. Miles may be redeemed only for flights as defined and described in these Terms & Conditions, subject to the restrictions contained herein, and any others that may be added from time to time at EurMile's sole discretion. 5) Mileage Credit to Member Accounts: EurMiles will post mileage credits to Member accounts when it receives confirmation from a participating Merchant that the Member has: (a) made a purchase of qualifying goods or services from that Merchant; (b) clicked through to the Merchant's website when a "click and earn" offer is published; or, (c) taken advantage of a Merchant offer posted on the EurMiles website. In every case, Members must comply fully with the respective Merchant's requirements for mileage eligibility. Such actions must be initiated by the Member from the EurMiles website at www.EurMiles.com for mileage credits to be earned, except in the case of mileage credits earned from direct award by a merchant on the merchant's website or in the merchant's place of business. Merchant mileage award-reporting to EurMiles usually happens within 48 hours of the time of the customer action, but in some cases may take longer. EurMiles posts mileage credits to Member accounts only upon notice from Merchants, and is not liable for Merchant failure to report such purchases. Miles earned by shopping are awarded on the basis of the cost of goods or services purchased, exclusive of tax, shipping or any other special charges. Miles earned by clicking through to participating Merchant websites will be credited only in accordance with the published requirements and restrictions. 6) Mileage Debits to Member Accounts: Merchants also report to EurMiles any credits issued to customers for cancelled orders, unfilled orders, returned merchandise, refusals or inability to pay agreed commissions, etc., and upon receipt of such notification, EurMiles will debit such credits from Member's account. 7) Free Ticket Redemption, Cash Credit, Purchasing Miles: Free tickets must be ordered at least 30 days prior to planned departure date and trips must be flown on the carriers and over the routings selected by EurMiles, or its travel agency, from and to an airport that may be within 90 miles of the member's preferred airport if the fare at the member's preferred airport is higher than £300, and if the fare available at the more distant airport is 20% or more below the fare available from the closer airport. Trips must also include a Saturday-night stay. Whenever possible, Members will be able to choose among airlines offering similar fares and routings, but if only one airline offers an eligible fare (see Section 13, "Type of Ticketing") then the Reward ticket will be issued on that airline unless Member prefers to travel at a different time or on a different date. If you have 22,500 or more miles in your account, but less than 25,000, you can purchase the miles you need at the time you Redeem a Reward at a cost of £0.025 (two and one half pence) per mile. 8) Mileage eligible for Free Ticket Redemption: Free tickets can be ordered by a Member when at least 90 percent of the mileage in the Member's account has been there for at least 30 days. Should EurMiles receive from one of its Merchant partners a mileage debit notice for miles already credited to Member's account and used by Member for a free ticket, EurMiles will deduct those miles from any remaining in Member's account after the free ticket has been issued. 9) Travel Reward Changes, Cancellations: Should you decide to change your reservation or itinerary after your ticket has been issued, you will be responsible for any fees imposed by the airline plus any applicable increase in airfare, according to your itinerary and fare class as defined in the tariff of the carrier on which your transportation is arranged by EurMiles. 10) Taxes, Surcharges And Fees: All taxes and airport fees applicable to Reward tickets, including Passenger Facility Charges, are the responsibility of the Member and must be paid by credit card at the time of ticket issuance. Payment of airline-imposed surcharges not included in published fares, and of other taxes, if any, on the value of the Reward ticket is the sole responsibility of the Member. 11) Transferability: Reward tickets may be issued in the name of any person designated at the time of redemption by the Member against whose account the Reward is being debited. 12) Credit In Lieu Of Free Ticket: If a Member wishes to travel with less than 30 days' notice, or on an itinerary without a Saturday night stay, or to a destination outside the European Economic Area, or to a destination where the lowest fare requires more than two connecting flight segments each way, Members may elect to apply a £250 credit to any ticket they wish to purchase. Such credit application may only be made through EurMiles's travel agent when the ticket is purchased through them and all charges in excess of the £250 EurMiles credit are paid by the Member with a valid credit card. Members who elect this option must allow at least 5 working days prior to departure for reservations and ticketing. 13) Type Of Ticketing: Whenever possible, tickets issued will be electronic tickets, confirmed by providing Member an airline-issued itinerary or confirmation number by e-mail and/or by telephone. If you want a paper ticket, overnight delivery charges for a signature-required envelope will be collected by credit card at the time of ticketing. Free Reward tickets will be purchased in the airline's lowest available advance-purchase fare class. Reward tickets will only be issued when seats in such fare classes are available. When such seats are not available, the most convenient alternative departure times or dates when those seats are available will be offered to the Member. Alternatively, EurMiles may choose, at its sole option, to send member a cheque in the amount of the lowest fare listed on www.expedia.co.uk, www.opodo.co.uk, www.ryanair.com, www.easyjet.com, www.bmibaby.com, www.buzzaway.com. 14) Lost, Stolen Tickets; Misused Itinerary Numbers: Once issued, whether in electronic or paper form, tickets are the Member's responsibility. Lost, stolen or misused tickets. or electronic itinerary/confirmation numbers, will not be replaced and are the sole responsibility of the Member. 15) Other Liability: Once a Reward ticket is issued, Member enters into a contract of carriage with the airline(s) on which the ticket was issued, and EurMiles will have no responsibility or liability for any loss or damage incurred in connection with your flight(s) on that airline(s). 16) Validity: Program is not valid where prohibited by law 17) Cancellation, Revision: Program or its Terms and Conditions can be cancelled or revised at any time, without notice except by the posting of such changes on the program website at www.EurMiles.com, under Terms & Conditions. Program may be cancelled at EurMiles's sole discretion and and in the event of program cancellation, EurMiles will not be liable for miles in Member accounts. Members are responsible for periodic reviews of EurMiles's Terms & Conditions to assure their understanding of and compliance with them. 18) EurMiles's Responsibilities: EurMiles is not an agent or representative of any of its merchant or other partners, and is responsible only for awarding the published mileage Awards to its Members who take actions that generate such Awards. EurMiles is not responsible for any activity or consequence of activity between its Members and its Merchant partners, or between its Members and its Reward partners (airlines). EurMiles is not responsible for any damages which may occur as a result of purchase or use of products or services from a merchant awarding EurMiles miles via e-mail messages, directly or through the EurMiles website. EurMiles makes no warranties, express or implied, with regard to any product or service purchased through a merchant listed on its website or merchant offers made via EurMiles e-mails. EurMiles is not a party to, nor cannot resolve disputes between customers and its merchant or other partners. 19) Fraud, Account Audit, Violation Of Terms & Conditions: Any fraudulent act in regard to this program, or violation of Terms & Conditions, will result in forfeiture of all mileage earned, and may also result in prosecution to the fullest extent of applicable laws. EurMiles's determination that fraud has been attempted or occurred is contestable by affected member(s) only in the venue specified in Section 23 of these Terms & Conditions. When EurMiles, in its sole judgment, believes that referral fraud may have occurred, it shall have the right (but not necessarily the obligation) to request from a member the name, address and telephone numbers of each person that the member referred to EurMiles who then allegedly joined the Program as a result of the member's referral. EurMiles may put Member's free ticket request in suspension for up to 30 days, pending investigation, and may then contact those people to determine the authenticity of the referrals. Refusal or failure to provide EurMiles such information within 3 working days of the date of EurMiles's request to the member will be interpreted to indicate that the referral activity was fraudulent, as shall EurMiles's inability to confirm that people referred by the member exist and actually joined the Program themselves, as opposed to having been enrolled directly by the Member claiming referral credit for them. EurMiles may also ask a member whose ticket redemption request has been placed in suspension for other information or documents to aid its investigation, and member refusal to cooperate by provision of this information or documents will be interpreted to indicate that the referral activity was fraudulent. Member accounts are audited for Terms & Conditions compliance and mileage deposit accuracy upon member's submission of a free ticket request. 20) Privacy Policy/SPAM: You can rely on us to protect your privacy. We will never share information about you without your permission. For more information, see our Privacy Policy. We do not endorse or use "spamming" e-mail tactics, and Members who misuse the Member Referral email forwarding options on our site to send email to people whom they don't know can suffer account cancellation (see Section 19 Fraud, Violation of Terms & Conditions). 21) Referrals: EurMiles's award of mileage credits for referrals requires that: /a.) the referred individuals are different people from the referring member, /b.) that they are at least 16 years of age, /c.) that they are otherwise eligible for membership, /d.) that no more than 1 person in the referring member's household may be referred, and /e. that the referred person personally and directly joined the Program. Members are not allowed to directly enroll other people. 22) Click Mileage Limitation: Members redeeming a free ticket reward may apply no more than 7,000 miles earned by clicking to merchant websites listed on EurMiles's Click and Earn page or Click miles earned from responding to advertising emails or play and earn emails. The balance of the redeemed miles must have been earned by: /a.) registration, /b.) referrals, and/or, /c.) shopping. 23) Governing law: This program is governed by the laws of England. Member agrees that any dispute or claim will be settled by the English courts. 24) E-Mail: EurMiles sends periodic communications to Members about the Program, special merchant offers and other information relevant to program participation. By registering at EurMiles you agree to receive such e-mail. You can opt out at any time. 25) Acceptance of Terms & Conditions: Members who register in the EurMiles Reward Program accept and agree to abide by these and any subsequently-issued Terms & Conditions at the time and by the act of their registration.
